This website, including the running plan generator, the route editor, run club pages, user accounts, the newsletter and all related content and features (the "Service"), is operated by RUNCULTURE. By using the Service, you agree to these Terms and Conditions.

If you do not agree to these terms, you must not use the website or the Service.

1. Definitions

  1. User: any natural person or legal entity that visits the website or uses the Service.
  2. Service: all functionality offered by RUNCULTURE, including the running plan generator, the route editor, run club pages, user accounts, the newsletter, training advice, articles, downloads and other content.
  3. Content: all information, text, schedules, training plans, routes, images, calculations and advice made available through the Service.
  4. Plan: a generated running plan created by a User or viewed and/or shared by others.
  5. Route: a running route generated or drawn via the route editor, which can be saved and/or shared.
  6. Account: a personal user account that allows the User to manage plans, routes and preferences.

2. Applicability

  1. These Terms and Conditions apply to every use of the website and the Service.
  2. Any deviation is valid only if agreed in writing between RUNCULTURE and the User.

3. Use of the Service

  1. The Service is intended solely for informational and recreational purposes.
  2. The Content does not constitute medical advice, personalised training guidance or a substitute for consulting a doctor, physiotherapist or other professional.
  3. The User is fully responsible for:
    • assessing their own physical capacity;
    • carrying out training safely;
    • consulting a doctor in case of health complaints or doubt.
  4. RUNCULTURE does not guarantee that the Content is suitable for the User's specific situation.

4. Use at your own risk

  1. Use of the Service and the Content is entirely at the User's own risk.
  2. RUNCULTURE is not liable for:
    • injuries, physical harm or mental harm;
    • consequential damages, loss of income or other indirect damages;
    • incorrect interpretation or implementation of plans or routes;
    • errors in generated plans, routes or calculations;
    • the use of plans or routes created or shared by others.
  3. The User indemnifies RUNCULTURE against all third-party claims arising from use of the Service.

5. Accounts

  1. Creating an Account is voluntary; parts of the Service can also be used without an Account.
  2. The User is responsible for access to their own sign-in method (such as the linked email address) and for everything that happens through the Account.
  3. The User can delete the Account at any time via the profile page; the associated personal data is then deleted as described in the Privacy Statement.
  4. RUNCULTURE may block or delete an Account in case of abuse, fraud or violation of these terms.

6. Publicly accessible and shared plans and routes

  1. A Plan or Route created by a User may be publicly accessible or may be viewed, used or shared by others.
  2. The exclusion of liability applies to every person who views or uses a Plan or Route, regardless of who generated it.
  3. RUNCULTURE has no control over how Plans and Routes are shared by Users and accepts no responsibility for this.

7. Routes and road safety

  1. Routes are generated automatically or drawn by Users based on public map data. RUNCULTURE does not guarantee that a Route is safe, passable, up to date or suitable.
  2. The User assesses the situation on the ground, always follows the applicable traffic rules and deviates from the Route when circumstances require it.
  3. Running a Route — including a Route shared by others — is entirely at the User's own risk, in particular in traffic and on unpaved or poorly lit paths.

8. Run clubs

  1. Information about run clubs is partly supplied by Users, clubs or external sources; RUNCULTURE does not guarantee its accuracy or currency.
  2. Claiming or managing a run club page is reserved exclusively for people authorised to represent the club in question.
  3. RUNCULTURE may amend or remove incorrect, misleading or inappropriate listings.
  4. Participation in a run club's activities is a matter between the User and the club; RUNCULTURE is not a party to it.

9. Newsletter

  1. Anyone who creates an Account (or creates a Plan with an email address) receives the RUNCULTURE newsletter about the Service and similar services of our own. This is stated at the moment the User leaves the email address, and the User can decline the newsletter right at the first sign-in.
  2. Without an Account, signing up for the newsletter is voluntary and takes place with the User's explicit consent.
  3. You can unsubscribe at any time, free of charge, via the unsubscribe link in every newsletter or via the profile page. An unsubscription remains in place, even if the User signs in again later.
  4. Receiving the newsletter is not a condition for using the Service.
  5. The processing of personal data for the newsletter is described in the Privacy Statement.

10. Availability and technical warranty

  1. RUNCULTURE strives to provide a properly functioning Service, but does not guarantee uninterrupted availability.
  2. RUNCULTURE is not liable for technical failures, data loss or incorrect functioning of the Service.
  3. RUNCULTURE may at any time:
    • modify the Service;
    • remove parts of it;
    • limit functionality;
    • perform maintenance without prior notice.

11. Intellectual property rights

  1. All Content, source code, functionality and designs of the Service are owned by RUNCULTURE, unless stated otherwise.
  2. The User receives a non-exclusive, non-transferable, revocable right to use the Content for personal use.
  3. The User is prohibited from:
    • copying source code or reverse engineering it;
    • commercially exploiting the Service without written permission;
    • republishing Content without attribution.

12. Data uploaded or entered by the User

  1. Data entered by the User (such as training distance, preferences, routes or settings) may be used to generate Plans and Routes and improve the Service.
  2. The User remains responsible for the accuracy of the data entered.
  3. RUNCULTURE reserves the right to block abuse, spam or unwanted behaviour.

13. Privacy and data processing

  1. RUNCULTURE processes personal data only in accordance with the Privacy Statement, which forms an integral part of these terms.
  2. RUNCULTURE complies with the requirements of the GDPR.
  3. The User declares that they have taken note of the Privacy Statement.

14. Restrictions and prohibited use

The User may not use the Service for:
• collecting data by scraping;
• commercial exploitation without permission;
• misleading others about health claims;
• distributing harmful information;
• attempting to manipulate or hack the Service.

15. Limitation of liability

  1. The total liability of RUNCULTURE is at all times limited to a maximum of EUR 50, unless mandatory law provides otherwise.
  2. This limitation applies regardless of the form of the claim: contractual, tort, negligence or otherwise.

16. Changes to the terms

  1. RUNCULTURE may amend these terms at any time.
  2. Changes take effect as soon as they are published on the website.
  3. Continued use of the Service constitutes acceptance of the amended terms.

17. Governing law

  1. These terms are governed exclusively by Dutch law.
  2. Disputes will preferably be resolved by mutual consultation.
  3. If this is not possible, disputes will be submitted to the competent court in the district where RUNCULTURE has its registered office.
